Consecuencias jurídicas y político-criminales de la elevación de la edad del consentimiento sexual en los derechos sexuales y de salud sexual y reproductiva del menor de edad

Resumen
A lo largo del año 2015 se concretaron una serie de cambios legislativos importantes, algunos de forma subrepticia, en aspectos esenciales que afectan los derechos del menor de edad y su capacidad de decisión, especialmente en relación con los derechos sexuales y de salud sexual y reproductiva. La elevación de la edad del consentimiento sexual y las modificaciones en materia de aborto que afectan a las menores de 16 y 17 años, son solo dos de las reformas más visibles, de las muchas que finalmente se emprendieron, que buscan excluir o limitar la autonomía de estos, y sobre todo, modular la realidad a través de la construcción social de la misma con base en el concepto de "pederastia" con claro contenido moral. Este artículo muestra las consecuencias jurídicas y criminológicas, personales y sociales de esta opción político-criminal y propone algunos criterios para dotar de efectos jurídicos al consentimiento del menor de edad en el marco de una teoría de los derechos constitucionalmente fundada.
