¿Cumplimiento de condena en prisión civil o militar? la controversia del concurso de delitos en la jurisdicción castrense a propósito del delito de tráfico de drogas

Abstract

The members of the Armed Forces are subject to a legal relationship of special subjection that has a special significance in the criminal sphere given the existence of a military criminal law, military jurisdiction and military penitentiary establishments. Faced with the imposition of a prison sentence, article 12 of the Military Penal Code (CPM) establishes that compliance with it will be carried out in military establishments except in the case of the commission of a common crime whose conviction entails the extinction of the employment relationship, which in which case will be executed in a civil establishment. However, the wording of art. 12 of the CPM does not provide for the legal solution to situations in which there is a commission of common and military crimes for the same acts, that is, what is called an ideal contest of crimes (of a mixed nature, civil-military). Using as a reference the ideal competition between the crime of public health (art. 368 ordinary CP) and the military crime of boarding toxic drugs on a warship (art. 75.2 CPM) and, given the defective wording of the precept, an analysis is carried out on the criteria must be used to resolve the legal gap generated by the current wording of article 12 of the CPM.
