The sentence of the CJEU of the 6th febrary 2019, establishes a new delimitation between the Insolvency and the Brussels I bis Regulation. The delimitation is based on the fact that the scope to which a claim corresponds is not the procedural context, in which it is registered, but the legal basis of the claim itself, which is what will allow clarifying whether the source of the right or the obligation underlying demand, are the general rules of civil and commercial law or special rules
