Abstract
Abstract: The reform of the Criminal Code, raised in the Draft Law on sexual and reproductive health, turns the desire of women to rid themselves of trauma pregnancy, as something exceptionally tolerated, into a right to be exercised without limit during the first 14 weeks of gestation. Therefore, this work questions the constitutionality of the Project from the perspective of the unborn child (nasciturus) lives considering it a legal right worth of protection. Keywords: Abortion.
