Abstract

The Constitutional Court considers that it is forbidden to use the hidden camera technique in investigative journalism. Consequently, states that there is injury to the rights to privacy and own image of the person captured. There has been a substantial increase in the spatial domain protected by the right to privacy. A conversation refers strictly to the professional is not a conversation that belong to privacy even a private conversation. If the goat can be achieved using different techniques and less damaging to the rigts of personality, the hidden camera can not legally shelter in investigation journalism. But the ban is not absolute.
