Abstract
The Law 19/2013, of December 9, on Transparency has meant the definitive breakthrough the paradigm of public transparency. However, the legislator opted to maintain the right of access to information in the limited scope of Article 105.b) of the Constitution, as a simple right of legal configuration. Although this criterion could be understood in 1992, it is not adapted to the new international parameters: the right of access to public information is a manifestation of the freedom to be informed, essential in a democratic State of Law and, therefore, is a fundamental right integrated in Article 20.1.d of the Constitution.
