Abstract

The attribute of the right of assembly to position itself functionally in scenarios of coincidence with another series of liberties and protectable rights, for some with a profile of instrumentality and for others of affectation, makes it a right of particular complexity. From the multiplicity of viewpoints from which the analysis of the right of assembly can be approached, here is proposed a not static but dynamic perspective of the doctrine emanated from the ECHR on the protective and restrictive margins that the recognition of the right of assembly is dispensed in article 11 of the Convention, contemplating its possible projection in the area of regulation that this right receives in the Spanish legal system, and in a particular way when it is exercised in the field of labor relations.
