La mención de la legítima en el registro de la propiedad por la vía del art. 15 LH

Abstract

Article 15 of the Mortgage Law regulates in a very long precept the mention of the legitimate one in the Property Registry. The standard under study only applies when the existence of a legitimate one that has not yet been perceived is known. In the cases in which the legitimate one has been perceived to the satisfaction of the legitimary, or the latter has renounced it, or the period of twenty years has elapsed since the death of the deceased, the mention shall not be made or cease to take effect. The first paragraph establishes the possibility of mentioning the legitimate one when the heir is authorized to pay it with money or non-real estate and the case of the legitimate Catalan. The following paragraphs regulate the mention of the registry when it is intended to satisfy the legitimate one with real estate registered in the Registry. All hereditary assets are subject to the payment of the legitimate assets for a period of five years from the date of the registration (solidarity mention). Three concrete modalities of mention are studied in depth: the allocation of concrete real estate for payment or in payment of the legitimate one, the effect of concrete real estate in guarantee of the legitimate ones and the allocation of an amount for payment of the legitimate ones. The first two are cases of reduced mention.
