Abstract

The coordination of national social security systems of the countries that have ratified the 2007 Multilateral Ibero-American Social Security Convention, is a necessary instrument to ensure to migrant workers and their family members the enjoyment of some social security rights. The principle of equal treatment plays a main role in this context by applying to migrant workers the State law where they work, under the same conditions as to national workers. This way is possible the consolidation of employment, insurance or contribution periods, which are needed to access to benefits and also to retain the right to benefits. However, the effectiveness of the principle of equal treatment will be compromised or disturbed by external obstacles to the Convention itself. Discriminatory inequalities on grounds of nationality in access to employment and working conditions and, most importantly, the lack of recognition of the fundamental right to free movement of workers in the community of Ibero-American States, can detract from equality achieved in terms of social security.
