Abstract

An approach to the concept of Big Data and the types of data storage that comprise it and the scope of Smart Data and the profiles. The protection and conservation of data in cases of prosecution of crime at Directives 95/46/EC, 2002/58/ EC, 2006/24/EC and the recent 2016/680/EC, as well as Regulation 2016/679/EC. The protection of natural persons with regard to the processing of personal data by the competent authorities for the purpose of prevention, investigation, detection or prosecution of criminal offenses or the execution of criminal sanctions, and free circulation of said data. Given this scenario, the possibility of using profiles in electronic surveillance and the new problem that would arise, Smart Data in general. The individual can be at the center of an investigation, which invades private life, including the most intimate one, and can compromise the presumption of innocence. Research and criminal surveillance has at its disposal, today technological means, which must be used in accordance with the provisions of the law to prevent interference with fundamental rights. These advanced investigation procedures, provided under the principles of specialty and proportionality, with due judicial authorization, represent an advance in the fight against crime.
