Laburpena

This work addresses the problem of the serious violations of human rights perpetrated by public servants in Argentina. These violations oblige to the State to investigate and punish those responsible with the objective of avoid fall to in international responsibility. In order to achieve this purpose, first the article develops a detailed jurisprudential analysis of the sentences of the Inter-American Court of Human Rights relating to the same matters, because Argentina shapes the Inter-American system for the promotion and protection of human rights. Thus, the way in which that court refuses any measure that limits or excludes the criminal liability, will be observed. Furthermore, the Inter-American Court declares the imprescriptibility –under certain conditions- of human rights violations committed by members of the State. Finally, the solutions envisaged in the argentine legal system –on the part of the Argentinean Supreme Court of Justice-, will be reviewed. These solutions that have been devised are in line with the proposals of the Court of San José in the Republic of Costa Rica
