Abstract

LO 2/2019 introduced a new crime in Criminal Law, among road safety crimes, in art. 382 bis, which punishes the driver who leaves the scene of the accident after causing it. The Law indicates that the new crime responds to the important social demand given the increase in reckless accidents with affected pedestrians and cyclists. It is a hit and run crime, with similarities to the omission of the duty to help of art. 195 of Criminal Law, although different, created to cover cases not covered by art. 195, so it will be necessary to analyze its elements and define its applicability.
