Abstract
This paper critically analyzes the European Court of Human Rights case law on transsexuality and sex change, bearing in mind the legislative and courts doctrine changes that have occurred in recent years. The right to gender identity is present as the backbone of the discourse, since the rights of transsexuals are based on this right «in the construction phase».
