Abstract
Loyalty and honor constitute two values of vital importance in the field of the armed forces. Consequently, the existence of a criminal type that punishes those acts that attempt against such values is required. Although, due to the fraudulent nature that the criminal action requires, the figure of the evidence must be used to glimpse evidence that allows knowing the intentionality of the investigated and condemning it without affecting the right of the presumption of innocence
