Abstract

The right to a trial without undue delays can be distorted when we encounter trials of long and complex processing within the intervention of multiple defendants. What happens if this right to a trial without undue delays is questioned before High Court while judging a macro-trial? This will be studied throughout a detailed analysis of Spanish High Court Judgment 507/2020, October 14th, where, inter alia, the undue delays suffered by the accused of the denominated first “Gürtel Case” period (from 1999 until 2005) are processed. The present work conducts, firstly, a doctrinal and jurisprudential study about the right to a process without undue delays. After that, the fundamentation of the High Court is assessed regarding the inexistent mitigating circumstance of undue delays. Finally, some conclusions that can be extracted from the study in this article will be exposed
