Zusammenfassung

The request for the extinction of the alimony for children of full age, urged by the parent who doesn’t have the custody in demand for modification of measures, requires the allegation of other reasons in addition to the simple coming to the age of 18 years, already referred to in the Civil Code and developed extensively by the case law, since most of the children of that age are still living and economically dependent on their parents. The establishment of other age limits and criteria will depend in large measure on a case-by-case basis and the personal circumstances of both the son or daughter and the parent required to pay, because it is not, anymore, an unconditional nor absolute obligation, as in the case of minors. This article focuses on the legal assumptions and their different application by courts, as well as the application.
