Abstract

The Draft Bill on Procedural Efficiency Measures for the Public Justice Service, currently before Parliament, contemplates modifications to the ordinary trial and the oral proceedings with the aim of streamlining procedures and making proceedings more efficient, highlighting the effects of the use of technology, especially the implementation of videoconferencing for judicial proceedings. Also, the constant referral to the alternative dispute resolution (ADR), a procedural requirement that determines the inadmissibility of the claim, and during the procedure to seek an out-of-court settlement. Finally, in oral proceedings, important new features have been introduced, such as the adjudication of the trial without oral proceedings in cases that are not complex and where the evidence is exclusively documentary; the possibility of issuing oral judgements, and the establishment of the witness procedure, in claims filed in the same court with a substantial identity of object.
