Abstract

This paper focuses on the case law of the European Court of Human Rights on the enforcement of arbitral awards. Starting with the recent decision in Holding, A.S. v. Slovakia, it analyses some of the most relevant precedents in this area. After comparing the different decisions, it identifies what is new in Holding, A.S. v. Slovakia and concludes that the ECtHR recognises and protects the right to enforce an arbitral award. Finally, the practical consequences of the recognition of this right are set out. This analysis is carried out in the context of a broader reflection on the relationship between the ECHR and arbitration.
