La Ley Integral para la Igualdad: Un frágil puente entre el Derecho Europeo y la Constitución

Abstract

This study globally analyzes the effectiveness of the Spanish “Equality of Treatment and Non-Discrimination Comprehensive Act” (15/2022), regarding the preventive, protective and promotional functions of anti-discrimination regulations. To do this, it starts from the idea that this norm has the challenge of connecting two very different regulation models: the particularist model of European Union Law and the universalist model of the Spanish Constitution and the multilateral human rights treaties. This would be appropriate in order to take advantage of the benefits and overcome the weaknesses of each one of them. From this perspective, the main shortcoming of this new regulation is the absence of a truly “comprehensive” concept of discrimination clearly differentiated from the principle of formal equality, which is particularly necessary in a universalist model that has an open clause for determining discrimination causes. As a result, the justification mechanism applied for indirect discrimination is transfered to direct distinctions, which is at odds with EU regulations and constitutional case-law. Although this work is fundamentally evaluative, it addresses some interpretive problems that the law has generated from the beginningt, such as the incorporation of “disease” as a cause of discrimination or the reference to “intolerance actions” .
