Abstract

The proposals made by the researches of LLobet Rodriguez concerning the constitutional support for due process guarantees in BECCARIA and the principle of proportionality could have influenced nowadays in the time of facing new research projects of penal doctrine about the criminalization of hate speeches. Thus, in these cases, we see how some part of this vision shows itself in the critical studies against the actual reforms. With this article, we wish to show the existence of that relationship and its possible implications by analysing different authors and comparing their doctrinal proposals
