Abstract

This paper studies the evidentiary value of uncontradicted witness statements in the pre‐trial phase of criminal proceedings in light of the STJUE of December 8, 2022 (Case C‐348/21), of the applicable legislation and the jurisprudence of the CJEU, the ECHR, the TC and the TS in this regard. Finally, our courts are urged to make a more favorable interpretation of the provisions of art. 730.1 LECrim and a modification of the wording of this article is proposed in the event of a future reform of this regulation.
