Resumo

This sentence responds to requests for prejudicial decisions relating to the effects derived from the declaration of nullity of abusive clauses in contracts concluded with consumers and concerning the calculation of the prescription term for the claim for restitution of what has been delivered by the null clause. The decision determines the requirements for judicial integration derived from the nullity of abusive clauses and the circumstances that allow for the total nullity of the contract. It also analyses the determination of the «dies a quo» of the prescription term of the consumer's action aimed at obtaining the restitution of the amounts unduly paid to a professional in applying an abusive clause contained in a credit contract.
