Abstract

The Spanish Constitution of December of 1978 received, in its elaboration, some influences of Comparative Law. Between these Letters Magnas occupies a place of stand out the Constitution of the Portuguese Republic (April 1976), approved shortly before the Spanish Constitution, and followed especially in which it respects to the fundamental rights and to the public freedom. In that sense, it is some portuguese rights arising from the needs of the life of middles of the seventies of last century (the dangers of the Computer science, the right to the medium atmosphere, the rights of consumers and users).
