From the sector of the legal system that deals with the social protection of employed workers, suicide becomes particularly relevant. Both scientific doctrine and jurisprudence discuss its nature as a common or professional contingency. Through this small study, the arguments that justify one or the other position will be exposed, based on Spanish legislation, but without failing to make brief referential notes on Brazilian Law. In general terms, it can be observed how there has been an evolution around suicide. If in the early days suicide was automatically considered a non-work accident, now the interpreter makes an application of the standard more in line with the Social State that allows, in certain cases, to classify the autolytic act as a work accident
