Abstract

This article aims to highlight the relevance of the Interamerican system of human rights in the promotion of human rights in times of distress. The different bodies of the system have gradually woven a network of norms of soft law and jurisprudence that have no mach in the rest of the world, and hence should be taken as a reference for other instances of protection. Specifically, the article refers to the course of action adopted within the western hemisphere human right’s protection system after the outbreak of the Covid pandemia as regards pushbacks, holding centers and medical treatment. Undoubtedly, the yardstick of protection according to this evolution needs to be enlarged for the sake of human dignity, regardless of the state of necessity alleged by the States. All aforementioned, a set of high principles and standards summarized in the judgement Velez Loor c. Panama will gain strength and not be overlooked if monitored by human rights advocates, NGO’s, National Commission, Ombudsman or similar, and international bodies or processes given that compliance by the States is always lukewarm.
