Abstract

In this article we analyse how the recent Act 35/2015, of 22 September, reforming the system for the assessment of damages caused to persons in traffic accidents has treated the issue of causation in low-speed collisions and how the biomechanics expert evidence influences this type of collision. It is a complement to what we have already studied in our previous article published in the journal La Ley and an update to the new scale that introduces the analysis of the issue through the so-called compensation for minor injuries of the spinal column, framed in Part 3 on Compensation for temporary injuries. It's a very new issue and it remains to be seen how the case law is dealing with it, focusing on whether case law breaks with the previous tradition of the practice of the biomechanics expert evidence or whether there could be a change in forensic practice.
