Abstract

The new legal framework regarding personal data protection has led to the creation ex novo of a figure known as Data Protection Officer (DPO) in the Spanish legal system. The RGPD [General Register of Data Protection] and the LOPDGDD [Organic law on data protection and guarantee of digital rights] have, in certain cases, made data processing managers and/or supervisors responsible for appointing this profile, as a consequence of which the number of professionals aspiring to satisfy this market demand has surged. The supranational rule envisages the services contract as a means for regulating the will of the parties, and this study focuses on highlighting the most characteristic features of this particular contractual relationship.
